NEW: Suspect in Marion cross-burning case sent back to jail for violating bond conditions
A magistrate judge ordered the arrest of a Smyth County man facing charges in a racially-charged cross-burning case after probation officers testified that he violated terms of his bond.
James Brown was brought to federal court in Abingdon and then jailed after Judge Pamela Meade Sargent heard evidence of Brown lying to officers about a visitor found in his home who was found with illegal marijuana, according to official documents obtained from US District Court.
Part of Brown’s bond conditions stated a third-party advisor and his children were the only people allowed in his home.
Brown, 40, was indicted in July and accused of placing a burning cross in the yard of a black neighbor in Marion earlier this summer and lying to FBI agents about the incident. His trial is set to begin on February 8.
